These Terms & Conditions (“Terms”) govern your access to and use of the Clear Merchant Consulting (“CMC”) website and advisory services. By accessing or using this site, you agree to be bound by these Terms.

  1. Independent Advisory Status

CMC is an independent consulting agency providing merchant-services advisory support, RISK-management oversight, and account-stability consulting.
CMC is not a bank, payment processor, ISO, gateway provider, or lending institution.

All merchant accounts are underwritten, approved, priced, serviced, and monitored solely by their respective acquiring banks and payment processors.

  1. No Guarantee of Approval or Pricing

Nothing on this site constitutes:

  • A guarantee of merchant account approval
  • A guarantee of pricing, reserves, or fee schedules
  • A guarantee of timelines or underwriting outcomes

All approval decisions remain entirely at processor and bank discretion.

  1. Client Responsibility

You are solely responsible for the accuracy of any information submitted through our channels.
Incorrect, incomplete, or misleading information may result in delays, restricted terms, account freezes, or denial of underwriting.

  1. Advisory Discretion

CMC may decline representation or discontinue advisory if:

  • A business model falls outside processor-policy tolerance
  • Legal, regulatory, or reputational risks are identified
  • Required compliance frameworks cannot be satisfied

CMC is not obligated to justify non-engagement decisions.

  1. Data & Site Usage Disclosures

CMC may use analytics tools, cookies, and session-based tracking to:

  • Measure site performance
  • Improve user experience
  • Evaluate marketing effectiveness

These mechanisms do not modify the rights granted in the Privacy Policy.
All data usage practices are governed exclusively by the Privacy Policy.
